Real Property Records Filing Information

Recording Fees

  • $15.00 for the first page.   
  • $4.00 for each additional page.
  • Additional $0.25 per each name in excess of 5.

 

Requirements for filing Documents:

  • Must Contain a 1" Margin at the Top of Each Page.
  • Must have an identifying heading.
  • Must contain original signatures.
  • Must contain a notary acknowledgement.
  • Must be suitable for reproducing a readable record.
  • All signatures must have the name typed, printed or stamped.
  • Address of grantee must be in the body of the document.
    Absent any of the above, a penalty fee will be charged.

 

The office is not responsible for lien searches. All of our Real Property Records are open to the public for any type of search to be done on your own.

Forms of payment include credit/debit, cash, money order, or cashier's check.

It is the policy of the Waller County Clerk's office to return documents to the individual paying for the filing.

eRecording

The following entities may use eRecording to electronically file documents with our office:

  • An attorney licensed in the State of Texas;
  • A bank, savings & loan association, savings bank, or credit union doing business under laws of the United States or the State of Texas;
  • A federally chartered lending institution, a federal government-sponsored entity, an instrumentality of the federal government, or a person approved as a mortgagee by the United States to make federally insured loans;
  • A person licensed to make regulated loans in the State of Texas;
  • A title insurance company or a title insurance agent licensed to do business in the State of Texas;
  • An agency of the State of Texas.

 In addition to persons listed above, a county may authorize a person to file electronic documents or other documents electronically for recording with a county clerk if the county enters into a memorandum of understanding with the person for that purpose.  This subsection applies only to a county with a population of 500,000 or more.  Waller County has a population of 43,205, therefore we cannot enter into a memorandum of understanding with any other companies.
